:: If you have an email account, you get a lot of spam, emails offering you to become rich without working hard, get a degree without attending college or lose weight without exercising a bit, as well as any emails you don’t want to receive.
Since spam lies in the eyes of the recipient, some of your emails can also be the spam others don’t want to get, especially since CAN-SPAM.
The "Controlling the Assault of Non-Solicited Pornography and Marketing Act of 2003" took effect on January 1st 2004. Meant to address the growing issue that unsolicited commercial email has become in the United States, this act pre-empts many tougher state anti-spam laws.
According to the CAN-SPAM Act, any email that isn't an answer to a specific request and promotes any of your services or products can qualify as a "commercial electronic email" and should comply with the law.
Compliance Checklist
- Include the option to opt-out from your distribution list via a link to a web page allowing email recipients to unsubscribe or a special email address.
- Remove these email addresses from your distribution email list within 10 days.
- Add a valid physical postal address and a valid meaningful subject line.
- State your message "promotional" nature in the body of your email.
